DRAFT OF AMENDMENT XXVIII
TO THE CONSTITUTION OF THE UNITED STATES
Section 1. The District, which constitutes the seat of Government, is for the purposes of this amendment defined as the National Capital Service Area and the Non-National Capital Service Area. The Non-National Capital Service Area shall be treated as a State for all constitutional Intents and Purposes.
Section 2. The Congress shall exercise its Authority of exclusive legislation in all Cases whatsoever under the seventeenth Clause in the Eighth Section of the first Article of the Constitution of the United States in the National Capital Service Area. The Congress shall not exercise its Authority of exclusive legislation in the Non-National Capital Service Area of the District, excepting all federally owned Properties, unless when in Cases of Compelling National Interest the public Safety may require it.
Section 3. The twenty-third Article of amendment to the Constitution of the United States is hereby repealed.
Section 4. The Congress shall have power to enforce this Article by appropriate legislation.
Section 5. This Article shall be inoperative unless it shall have been ratified as an Amendment to the Constitution by the legislatures of three-fourths of the several States, or by conventions in the several States, as provided in the Constitution, after its submission to the States by the Congress
