Statement by Timothy Cooper, Executive Director, Worldrights, on the Legislative Yuan Resolution on behalf of Wangbingzhang

美國國際人權組織執行長顧堤姆為立法院決議案提案升冤枉炳章之聲明

 

During the past couple of weeks of rainy weather, it was often suggested in good humor that I'd brought the rains with me from America . Whether this was true or not, I don't know, but what I do know is that the bi-partisan group of Legislative Yuan members gathered here today and giving voice to their concerns about the trial and detention of Wang Bingzhang by China has brought a fresh flood of sunshine to this issue.

緊急個禮拜有不少人跟我開玩笑的 說 下雨折磨多的日子是不是我從美國華府帶來的 呢 是不是真的如此我並不清楚 但我很清楚今天一群跨黨派的立法委員居聚了在一起為了表示他們對王炳章被中國的審判和拘留之關心 , 已經給予了此問題帶來了新的光線

This is important because what Taiwan says about human rights in China matters.

這樣的舉動非常有意義因為中國確實很在乎台灣對他人權 狀 況的看法和 說 法

It matters that Taiwan stands up for the human rights of 1.2 billion people; it matters that Taiwan insists that the right to due process and a fair trial be respected; it matters that Taiwan calls on China to uphold the rule of law.

台灣人民會為十二億人們發聲是有意義的 , 台灣要求公平公正的司法程序必須被尊重是很重要的有意義的 , 台灣呼 籲 中國尊重一法制國的原則是有意義的

And it matters, and matters greatly that in a spirit of bi-partisanship Taiwan legislators have come together today to speak out with one voice to say: No nation stands above the law of the world.

而更有意義的就是 今天無倫黨派 依照發揮跨黨派合作和諧精神台灣的立法委員今天聚中在一起缺發出共同的聲音 沒有任何國家高於基本人權和國際法

The case of Wang Bingzhang is like no other. So I will give you its brief history. In June 2002 Wang Bingzhang, Yue Wu and Zhang Qi, were kidnapped in northern Vietnam after meeting with Chinese labor leaders. Men who identified themselves as Vietnamese police insisted they accompany them to the police station. Instead they were forcibly taken across the border into China . When Wang resisted, he was beaten.

王炳章的案件與 眾 不同 所以我簡單的為 您 們介紹以下 在 2002 年 6 月王炳章陪同岳武和張 琪 在越南北部於中國勞動權益團體領袖會務後輩所謂自稱越南警方被補同時被告之要求陪同前往警察局 預料以外的他們被 綁 架跨國中國邊界 一當王炳章反抗 , 就被打的

They were then given over to another group of men who were waiting for them in China . The operation was well-planned. The trio was blindfolded and led away and moved from place to place for days. A $10 million dollar ransom was demanded, but they could obviously not pay it. They were held for nearly a week before being taken bound and gagged to a Buddhist temple. There they were suddenly abandoned. Moments later, the Chinese police mysteriously appeared and “rescued” them. But they were not released. Instead, they were detained by the “rescuing” police.

後來又被 另 外一群在中國境 內 等待著他們的人 中共國安此跨國 綁 架行動已經時期話的非常之嚴密之 三位 綁 架受害者 連上被蓋上布料 所以看不見 後來 每 兩三天還地點 過了一個禮拜他們被帶到一個佛教寺廟 被 綁 起來 口也被蜂起來 突然間他們發現已經被遺棄了 可立即由中國警方神秘的突然的出現了所謂 ” 營救 ” 了他們 不過他們並沒有被釋放 所謂營救他們的警察確實把他們給拘留了

Separated, they were moved to various locations in China . For five months they were held incommunicado. All the while China denied knowing anything about their whereabouts, despite repeated inquiries by the French and US government.

三違背分開處理的 在中國個地方被調走的 經過漫長的五個多月沒有他們的任和消息 同時中國政府一直一致的 說 不知道此案 雖然美國和法國政府多次證尋過

Finally, in December 2002, China admitted holding them. Yue Wu was soon released, but Zhang Qi remained in custody. And Wang was charged with “spying for Taiwan ” and for leading a so-called “terrorist organization”.

終於在 2002 年 12 月中國承認了擁有他們 隨後岳武被釋放了 可張 琪 還是被拘留的 而王炳章卻依照為台灣蒐集情報和組織恐怖組織之罪名被起訴

In January 2003, Wang's trial was held. It was a half-day trial-- just a few hours. He was not permitted to cross-examine any witnesses. He was not allowed to mount a proper defense. As a result, he was convicted on both charges and sentenced to life in prison. His appeal was summarily denied.

在 2003 年元月王炳章的審判進行了 隻有半天 不到幾個小時 他們不准 她 跟任和所謂證人對質 他們不准他提供任和正常的辯護 說 詞或證據 因此他以兩項罪名之成立被審判無期徒刑 他的上訴被無開庭立即駁回

He received life in prison for “spying for Taiwan ” and ten additional years for leading a so-called “terrorist organization”. He was then put in solitary confinement in Shaoguan prison in Guangdong Province , where he has remained ever since.

他依照為台灣蒐集情報的荒謬荒唐罪名被審判無期徒刑 為組織所謂恐怖 份 子組織被審判十年有期徒刑 隨後他被放在廣東省邵關市監獄單獨牢房如今

But several months after Wang's conviction the UN Working Group on Arbitrary Detention determined that China had violated Wang's fundamental human right to a fair and impartial trial.

之後 聯合國禁止非法居留工作小組依法審判中國違反王炳章博士的享有公平公正審判的基本人權 .

It noted, among other things, that during Dr. Wang's first five months in detention, he “did not have knowledge of the charges, the right to legal counsel, or the right to judicial review of the arrest and detention: and that, after that date, he did not benefit from the right to the presumption of innocence, the right to adequate time and facilities for defence, the right to a fair trial before an independent and impartial tribunal, the right to a speedy trial and the right to cross-examine witnesses.” Nor did the UN find any basis for China 's charges of “espionage” and “terrorism.” The Working Group called for his immediate release and for China to honor its human rights commitments.

In November 2003, the Canadian Parliament's Standing Committee on Foreign Affairs International Trade passed a resolution in support of Dr. Wang. It stated that “the United Nations Working Group on Arbitrary Detention has determined that the charges are without foundation, that they are in violation of international law and that he has been denied the right to a fair trial.” It called on China to release Dr. Wang and permit him to be reunited with his family and colleagues.

在 2003 年 11 月加拿大國會外交及國際貿易委員會通過升冤枉博士的決議案 , 其 內 文顯示聯合國禁止非法拘留工作小組依法審判中國的指控為毫無證據的 卻違反國際發的 以及他並沒有得到公平公正的審判 他們要求中國釋放王博士 允許他和他家人團群

In May 2004, the US House of Representatives passed H. Con. Resolution 326, 399 to 0. It noted that “Dr. Wang Bingzhang was being arbitrarily detained in the People's Republic of China in violation of international law and that the United States Government should request the Government of the People's Republic of China to release Dr. Wang, permitting him to immediately return to the United States,” and that “the President should make the immediate release of Dr. Wang by the Government of the People's Republic of China a top priority of United States foreign policy.”

在 2004 年 5 月美國 眾 議員通過 326 好決議案 ,399 委員支持 , 無反對通過 .

 

此決議文聲明王炳章被中或人民共和國違反國祭法之非法拘留之 因此要求美國政府像中話人民共和國政府釋放王炳張 以便他立即返回美國 此外要求美國把中華人民共和國政府釋放王炳章之案件列為美國外交政策重點項目

In July 2004, Amnesty International sent out a worldwide, urgent medical alert on Dr. Wang's behalf. And later that month, the UN High Commissioner for Human Rights, Ms. Louise Arbour, promised her personal intervention on Dr. Wang's behalf. The Special Rapporteur Against Torture and the UN Special Representative of the Secretary-General on Human Rights Defenders also sent urgent appeals to the Chinese authorities regarding Dr. Wang's incarceration and medical condition.

In October 2004, 41 MPs of the House of Commons of the British Parliament supported an Early Day Motion calling “upon the Government to work with the UN High Commissioner for Human Rights to put pressure on the Chinese Government to release Dr Wang from custody so that he may receive adequate medical attention.”

在 2004 年 10 月 英國國會平民會之 41 委員連署要求政府配合聯合國人權組織秘書長給中國政府壓力釋放王博士以便他的到適當的醫療照顧

And in February 2005, Canadian Foreign Minister Pierre Pettigrew publicly expressed serious concern about Wang Bingzhang's trial and continuing detention.

而今年上個月 加拿大外交部長公開呼 籲 王炳章的審判和拘留 狀 況之嚴 厲 關切

During this time, Wang suffered a stroke in prison and his health went from bad to worse.

Recently, Wang's treatment by prison authorities has shown a marked improvement. We believe this is a result of international pressure. The higher the pressure, the closer draws the day when Wang Bingzhang will be released.

最近王博士的牢裡待遇有所改善 我們相信這是因為國際關心的關係 壓力越大 我們越接近王炳章會被釋放的日子了

That is why what Taiwan legislators are doing here today matters-- and matters greatly.

所以今天台灣立法委員來到了這裡所做的是很有意義的很重要的

The fact that the United Nations and so many nations have seen fit to condemn China's treatment of Wang Bingzhang matters, for it is clear beyond all doubt that China violated not only its own procedures under Chinese Criminal Procedure Law, but also under international human rights law with regard to Wang's right to a fair and impartial trial.

聯合國以及許多國家已經譴責了中國對王炳章的待遇 是很重要的 有意義的

 

因為人人可見中國的行為不但違反了他自己的所謂刑事程序發 他更是違反了國際人權法對王炳章享有公平公正的審判的權力

And in time more and more nations around the world will be expressing similar concerns. We hope therefore that China will consider its position.

隨者時間 會有越來越多的國家呼 籲 同樣的關懷 我們希望中國會重新思考他的立場

China will be a great nation only when it views fundamental human rights as something more than discretionary. The right to due process is not a discretionary right. It is a human right. Without such protections, there is only the chaos of arbitrary indiscretion in the life of a nation.

中國唯有遵守基本人權為必要的在能發揮大國的本能 政黨的司法程序不市政府可以隨其所願而決定之 他是一個人權 沒有此保障只有混亂的不確定霸權漂流在一個國家的生活中

So we are here today to say, without malice, but with a steady and complete resolve: CHINA , FREE WANG BINGZHANG!!!

所以我們今天來到了這立為了聲明 我們毫無惡意的 但堅決堅定不移的意志

" CHINA : FREE THIS MAN!!!”
